Information No. 67859 was filed by Stipendiary Steward, Mr S P Renault, against holder of License to Train, Mr N S Taylor, alleging a breach of Rule 865 (2) in that he “advised on the notifiable gear form that FAKE WHISPERING was wearing a fixed hood but was wearing a pacifier for this event”.
--Mr Taylor had signed the Statement by the Defendant on the information form indicating that the breach was admitted and that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.
--Rule 865 provides as follows:
(2) A horse may race with different gear from its last start when the owner, trainer or person in control of the horse has notified the change in the manner prescribed in the Approved Gear Regulations. Any such change is to be advised not later than the official time for notification of drivers as specified in the Notification of Drivers Regulations.
Mr Renault stated that Mr Taylor’s explanation was that he had notified the wrong gear on the Notifiable Gear Form that he had submitted in respect of FAKE WHISPERING.
--Mr Renault recommended a fine of $50.
--Mr Taylor was fined the sum of $50.
