Decision:

Following Race 9 an Information was filed pursuant to Rule 871(1) (D)

The informant Stipendiary Steward Mr A Coles alleged that Mr W Ismail (“Pinesqui”) allowed his mount to shift in when not clear of the “Black Night” (B Jones) causing that horse to be checked. 



Following Race 9 an Information was filed pursuant to Rule 871(1) (d).  The informant Stipendiary Steward Mr A Coles alleged that Mr W Ismail (“Pinesqui”) allowed his mount to shift in when not clear of the “Black Night” (B Jones) causing that horse to be checked.

Mr Ismail pleaded guilty to the charge and was represented by Mr H Allen.

Mr Williamson, Stipendiary Steward, demonstrated the video films which clearly showed Mr Ismail (“Pinesqui”) push his mount forward after being slow at the start.  Soon after this Mr Ismail took a hold of his mount and as a result moved in and into the line of the “Black Night” (B Jones) when insufficiently clear.  Mr Jones received quite a severe check as a result.

PENALTY SUBMISSIONS

Mr. Coles said the interference resulted from inexperience on Mr Ismail’s part but the result could have been much worse if Mr Jones had not taken quick action.  He said this was Mr Ismail’s first charge and submitted a 4 day suspension would be appropriate.

Mr Allen said on Mr Ismail’s behalf that Mr Ismail was inexperienced and he did have trouble with the horse in the preliminary and was thrown at the start.

The Committee considered all the evidence and penalty submissions and before imposing a fair penalty took into account the following:

  • His guilty plea

  • His first charge.

Accordingly we impose a suspension to start after racing today 9/1/09 and conclude after racing on the 21/1/09 (4 days).
