The information alleges that P Boylan the rider of CANYFLY allowed his mount to shift inward near the Winning Post when not clear of BLUE HORIZON (M Gillies)
The information alleges that P Boylan the rider of CANYFLY allowed his mount to shift inward near the Winning Post when not clear of BLUE HORIZON (M Gillies) causing that runner to check.
----Mr Boylan admitted the breach and was present at the hearing.
----The rule was read and Mr Boylan acknowledged he understood same.
----Mr Goodwin demonstrated the alleged incident on film and gave his interpretation of same. Mr Boylan had no questions of Mr Goodwin nor did he wish to give his interpretation of the film.
----In relation to penalty Mr Ray said the incident was of a minor nature and he had no knowledge of Mr Boylan ever having been charged in this or any other country, Mr Boylan confirmed this to be correct.
----The Committee when arriving at a penalty was of the view whilst the incident may have been only minor it did warrant a suspension.
----However the suspension must reflect :
--a. It was Mr Boylan's first offence.
--b. He did admit the breach and regretted his actions.
----Mr Boylan was suspended from the conclusion of racing on Saturday the 18th till the conclusion of racing on Thursday the 23rd of August, in effect 2 days.
