An information lodged by Stipendiary Steward Mr J Muirhead against Mr P Young driver of WOT THE OWL alleging a breach of Rule 864 (2) (e) in that he failed to activate the removable earplugs when driving out the horse
An information lodged by Stipendiary Steward Mr J Muirhead against Mr P Young driver of WOT THE OWL alleging a breach of Rule 864 (2) (e) in that he failed to activate the removable earplugs when driving out the horse over the concluding stages of the race.
--Mr Young admitted the breach and did not wish to be present at the hearing.
--Mr Muirhead demonstrated the incident by use of the video film. WOT THE OWL finished strongly along the passing lane but it was clear from the video that Mr Young made no effort to activate the removable earplugs. Mr Muirhead said that Mr Young had explained that he was having steering difficulties with the horse. WOT THE OWL finished in third place, five and a quarter lengths behind the second horse.
--PENALTY
--Mr Muirhead said that Mr Young had no relevant breaches of the rules recorded against him and he recommended a fine of $200.00. In fixing penalty I took into account the following matters :

- Mr Young's clear driving record. --
- The submissions of Mr Muirhead. --
- The explanation given by Mr Young. --
- The guideline penalty for a first offence is $100.00.
Taking those matters into account, I imposed a fine of $100.00.
