DECISION & REASON
--Following the running of race number 3 an information instigation a protest against horses 4 and 3 placed 1st and 3rd respectively by the Judge against horse number 6 placed 14th by the Judge was lodged by the Stipendiary Stewards. The information alleged a breach of Rule 869 (A) (8). The information was that with approximately 200 metres to run Jaccka Pistol (J Dunn) when racing between Dublin Boy (M R Hay) and Smart Shelly(M Jones) broke and lost its chance. Present at the hearing were Mr Hay, Mr Dunn and Mr Jones. The connections of the 1st and 3rd horses were represented by the drivers.
--Mr Dunn (Jaccka Pistol) said that with approximately 300 metres to run his horse was tiring and that Dublin Boy moved out when clear of his horse. At that time his horse had run its race and was hanging and struck the wheel of Dublin Boy, continued to pace and then ran out on to Smart Shelly and broke when hanging.
--Mr M Jones said that he was racing in a straight line and that the cart of his horse was bumped by Jaccka Pistol.
--Mr Hay said that he had moved into a position ahead of Jaccka Pistol prior to it breaking and did not believe his horse was responsible for Jaccka Pisotol's break but saw that it was a result of that horse's own actions.
--The Stipendiary Stewards showed the evidence of the incident which showed Dublin Boy moving out when clear of Jaccka Pistol and shortly thereafter Jaccka Pistol, when hanging, struck Smart Shelly and shortly after broke and lost its chance.
--The Committee, after considering the submissions of the drivers and the Stipendiary Stewards, are of the view that if there was any interference by either Smart Shelly or Dublin Boy it was nominal and that the racing manners of Jaccka Pistol were the reasons for it breaking. Accordingly, the protest is dismissed and the Judge's placings stand.
