Mr P Knowles, stipendiary steward, after race 5 laid an information alleging that contrary to rule 869(3)(b), Mr R Beale driver of POSH AS POSH, after some 800 metres drove carelessly

Mr P Knowles, stipendiary steward, after race 5 laid an information alleging that contrary to rule 869(3)(b), Mr R Beale driver of POSH AS POSH, after some 800 metres drove carelessly when improving between SMART HENRY (R Swain) and J C's SUPRIMA (A Suddaby) causing J C's SUPRIMA to break and lose its chance.

Mr Knowles demonstrated on the videos that Mr Swain was in the one out line with Mr Beale initially trailing that horse. Mr Beale then attempted to take a gap that had presented itself between SMART HENRY and J C's SUPRIMA which was racing on the marker line. J C's SUPRIMA was squeezed as the horses approached the bend and broke losing all chance. Mr Beale admitted the charge stating that he was simply too slow to take the gap. He said Mr Suddaby improved and he lost his chance to move into the gap.

Mr Beale, I find this to be careless driving at the lower end although I note J C's SUPRIMA did lose its chances as a result of your actions. Nonetheless, I accept Mr Knowles statement that you were simply in the wrong position and had not thought your actions through. Your record is very good with Mr Knowles rarely having occasion to talk to you and you have no breaches at all this season. You have also readily admitted the breach in circumstances where you could have required the stipendiary steward to prove his case. I fine you the sum of $200 and remind you of your obligations under the Rules of Harness Racing.
