An Information was lodged by Stipendiary Steward Mr TW Taumanu alleging that Junior Horseman Mr R Argue the Horseman of Extended Credit drove carelessly when he improved his horse outwards in the run home cause interference to Marquee Star (Driver RJ Brosnan) resulting in Marquee Star breaking and losing its chance.

An Information was lodged by Stipendiary Steward Mr TW Taumanu alleging that Junior Horseman Mr R Argue the Horseman of Extended Credit drove carelessly when he improved his horse outwards in the run home cause interference to Marquee Star (Driver RJ Brosnan) resulting in Marquee Star breaking and losing its chance.

Mr Argue admitted the charge and was present at the Hearing.

--

Mr Argue as a Junior Horseman is supported by his father Senior Horseman Mr SG Argue.

--

Rule 869(3)(b) provides:

--

“No Horseman in any race shall drive carelessly.”

--

Mr Argue acknowledged that he understood the Rule.

--

Mr Taumanu demonstrated the incident by use of the video film and this showed that Extended Credit had been racing towards the rear of the field and on the inside when the field turned for home.   Mr Argue attempted to improve on the inside of Mr Brosnan and his horse ran out and made contact with Mr Brosnan’s horse and caused that horse to break and lose its chance.

The Stipendiary Stewards advised this Committee that it was fortunate that the affected Driver was one of Mr Brosnan’s experience because this prevented the incident from being worse.

--

Mr Argue for his part acknowledged that he had caused the interference.   He had been trying to improve his position and his horse had run out further than he meant it to and this was the cause of the interference.   Mr Argue acknowledged that he had driven the horse before and he was aware of its tendencies.

--

The charge having been admitted is accordingly proven and the parties are asked for submissions as to penalty.

--

Mr Taumanu advised that the Stipendiary Stewards were looking for a suspension of Mr Argue’s license because this incident could have potentially been worse.   Mr Taumanu accordingly asked for a suspension of Mr Argue’s Horseman’s License up to and including the 6th of February 2010.

Mr Argue was asked if he had any declared drives and he advised that he had one drive at the Morrinsville Trotting Club’s Meeting in two days time on the 17th of January 2010.

--

Mr Argue Senior acknowledged Mr Taumanu’s submissions but asked that the penalty not be out of proportion to the offence.   He also pointed out that Mr R Argue is a Junior Horseman.

--

The Committee has taken the evidence and the submissions of the parties into account and notes that the suspension asked for by Mr Taumanu would involve five driving days.   Mr Taumanu as part of his submission asked Mr Argue if he was driving at the upcoming two day Kapiti Coast Harness Racing Meeting and Mr Argue advised that he was not.

The Committee noted the JCA Guidelines for this type of offence and also noted the number of drives that Mr Argue has had for this season.

--

Taking all matters into account this Committee orders that Mr Argue’s Horseman’s License is suspended from the conclusion of racing on the 17th of January 2010 up to and including the conclusion of racing on the 5th day of February 2010. (5 days)
