As a result of an incident in Race 8 at the Ashburton Racing Club’s meeting on Sunday 19th October 2008, Ms Danielle Johnson, the rider of ANZALI was charged pursuant to Rule 871 (1) (d) (careless riding).

--Ms Johnson pleaded guilty to the charge which is therefore deemed to be proved.
--I t was alleged that Ms Johnson allowed her mount to shift ground late in the race causing FIRST WIND, ridden by B Lammas, THE GUTTERSNIP, ridden by L Robinson and I COMMAND, ridden by J Todd, to be checked.
--The incident was demonstrated on the video from several different angles by Assistant Stipendiary Steward, Mr J McLaughlin. The incident happened within the last 50 metres of the race.
--Ms Johnson was supported by Mr Peter Williams, Licensed Trainer in the hearing because Ms Johnson is an apprenticed rider.
--By way of mitigation, Mr Williams asked us to look at the race at an earlier stage where Ms Johnson, who uses her whip in the left hand, did have to correct her horse when she began using the whip approximately 200 metres from the finishing post. She took appropriate corrective action at that stage. However, there was no denying the fact that in the last 50 metres, Ms Johnson did not take such corrective action and as a consequence, the horse went under the whip, and moved out quite significantly, inconveniencing the horses mentioned earlier.
--PENALTY DECISION
--Mr Ching advised that Ms Johnson had a good riding record. She received a suspension of five days in January 2008 but suggested she should be given credit for her guilty plea.
--The degree of carelessness was quite significant in this case, although, in our opinion, we would not place it at the top end of the scale. However, three horses were checked at a most important part of the race. We note that the protest that was lodged was subsequently withdrawn.
--In our opinion, a five day suspension would be warranted but we have given Ms Johnson credit for her guilty plea and her good record.
--Ms Johnson advised that she has engagements on Wednesday 22nd October 2008.
--Ms Johnson is therefore suspended from the conclusion of racing on Wednesday 22 October until the conclusion of racing on Monday 27th October 2008. Ms Johnson rides in the North Island as well as the South (Mr Williams said she was his second stable rider and normally would have been looking to engage for her for meetings at Gore on 24 October and at the Canterbury Jockey Club on Sunday 26 October 2008).
--The four day suspension that we impose is therefore encompassing meetings on 24th at Gore, 25th at Auckland, 26th at Auckland, 26th at the Canterbury jockey Club and 27th at Waikato Racing Club’s meeting.
