DECISION AND REASONS:

Following the running of Race 3, the 123racing.com Mobile Pace, an information instigating a protest was laid by Stipendiary Steward Mrs K. R. Williams alleging a breach of Rule 869(8). The information reads as follows.

"This is a protest against horse number (9) placed 4th by the judge on the grounds of interference to Bigtime Blue Jean (1) after approx. 200m."

Rule 869(8) reads as follows.

--

"The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:

--
    ------
      --
    1. may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
    2. --
    3. may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -
------

immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.

--

Present at the hearing were Mr K. M. Barron who was the driver of "Jaccka Ewen", and Mr C. T. Dalgety who represented the trainer and owners of that horse. Mr R. N. Burton the trainer, driver and part owner of "Bigtime Blue Jean" also attended the hearing.

--

Video coverage of the incident was shown to illustrate that Mr Barron was having a difficult drive trying to restrain Jaccka Ewen and that it ran into the back of "Bigtime Blue Jean" puncturing a tyre. Mr Dalgety advised that he did not dispute that Jaccka Ewen had caused interference and should be relegated to 6th placing behind "Bigtime Blue Jean".
