Following Race 2 an information was filed pursuant to Rule 871(1)(d), when it was alleged by the Informant, Mr C George, that Mr D Hain, rider of CAMPONESCHI, angled his mount outwards when not sufficiently clear of MIDNIGHT PRINCE

DECISION AND REASON:

Following Race 2 an information was filed pursuant to Rule 871(1)(d), when it was alleged by the Informant, Mr C George, that Mr D Hain, rider of CAMPONESCHI, angled his mount outwards when not sufficiently clear of MIDNIGHT PRINCE (G Cooksley) who had to check his mount near the 400 metre mark.

Mr Hain was represented by Mr M Baker, and pleaded guilty to the charge.

Mr Coles demonstrated on the race videos that at the 400 metre mark CAMPONESCHI, ridden by D Hain, angle out when insufficiently clear of MIDNIGHT PRINCE, ridden by G Cooksley. This caused Mr Cooksley to check off Mr Hain's heels and cause subsequent interference to FRILLY MILLY.

Mr George submitted a suspension should be imposed and described the careless riding at the higher end of the scale. He produced Mr Hain's record, which showed no transgressions.

Taking into account Mr Hain's good riding record, his guilty plea, and explanation, the committee believes a starting point of 4 days is appropriate.

--

Taking into account the above mitigating factors, the committee reduced the suspension to 3 days. The suspension is to commence after racing on the 27th of December 2006 and conclude after racing on the 31st of December 2006 (3 days).
