Decision: An information filed by Stipendiary Steward Mr N McIntyre against Miss N Chilcott, driver of BROOKFIELD RULER, alleging a breach of Rule 869 (3) (b) (9) – Careless Driving – in that she drove her horse carelessly in the run up to the start

An information filed by Stipendiary Steward Mr N McIntyre against Miss N Chilcott, driver of BROOKFIELD RULER, alleging a breach of Rule 869 (3) (b) (9) – Careless Driving – in that she drove her horse carelessly in the run up to the start which resulted in her horse hitting the sulky wheel of BROADWAY, driven by Mr D Butcher.

Miss Chilcott admitted the breach and did not wish to be present at the hearing.

Mr McIntyre said that BROOKFIELD RULER drew barrier four but in the run up was heading for the number five starting position.  Miss Chilcott then tried to manoeuvre her horse into the correct barrier position which resulted in the horse hitting the sulky wheel of BROADWAY.  BROOKFIELD RULER broke and lost a few lengths.

PENALTY

Mr McIntyre said Miss Chilcott had a clear driving record and that the offending was at the lower end of the scale.  There were mitigating circumstances in that BROOKFIELD RULER was proving a little difficult to drive.  He recommended a fine of $200.00.  In fixing penalty I take into account the following matters :

1.            The guilty plea.

--

2.            The clear driving record.

--

3.            The offending was at the lower end of the scale.

--

4.            The mitigating circumstances.

--

5.            The recommendation of Mr McIntyre.

--

6.            The starting point for a breach of this Rule is a fine of $400.00 and/or two weeks suspension.

--

Balancing all of those matters, with particular emphasis on Miss Chilcott’s excellent driving record, I impose a fine of $200.00.
