Following the running of the Wairewa Infinity Railway Handicap, C.Lammas, rider of the third placed horse, IMANANABAA  lodged a protest against the winner, DONNA ROSITA (L.Cropp) on the basis of interference inside the last 50 metres.

At the hearing the interests of IMANANABAA were represented by the owners, Messrs A.J.Sutherland, P.J.Walker and Sir Patrick Hogan, the trainer J.Gibbs and the rider, C.Lammas. DONNA ROSITA was represented by an owner, Mr Wheeler, the trainer, Ms P.Ranui and the rider, L.Cropp. Mr G .Rogerson was called, at her request, to assist Ms Ranui. Also present were  media representatives.

The case for IMANANABAA was put by Messrs Lammas, Gibbs, and Walker. Referring to the films of the finish their submission was that several strides off the line DONNA ROSITA moved out and bumped  IMANANABAA unbalancing the horse and causing it to lose crucial ground to the fast finishing GEE I JANE.

Ms Cropp and Mr Rogerson argued the case for DONNA ROSITA and again with referrence to the films submitted that IMANANABAA had moved inwards at least four horse widths inside the final 100 metres and that this movement was the dominant cause of the interference  claimed by  Mr Lammas et al.

Mr C. George (Chief Stipendiary Steward) was also of the opinion that IMANANABAA's significant inward movement was a major contributing factor to the incident.

The Committee, after reflecting on the submisions and the films of the finish finds that DONNA ROSITA did move out slightly more than a horse width short of the line. But the far more dramatic movement came from IMANANABAA which shifted in four to five horse widths without being corrected by Mr Lammas in circumstances where the opportunity to do so was available to him.In our view IMANANABAA's movement was a significant contributing factor to the contact with DONNA ROSITA and for that reason we consider the protest should be dismissed.

The judge's placings stand and we direct Mr Lammas'  filing fee be refunded.
