Following the running of Race 2, Robbie's Bar & Bistro New Brighton & Yaldhurst Mobile Pace, an Information was filed by Stipendiary Steward Mr N G McIntyre, against driver Mr S D Puckett, alleging that Mr Puckett used his whip excessively on MUSTANG LINIK over the final 400 metres.
Following the running of Race 2, Robbie's Bar & Bistro New Brighton & Yaldhurst Mobile Pace, an Information was filed by Stipendiary Steward Mr N G McIntyre, against driver Mr S D Puckett, alleging that Mr Puckett used his whip excessively on MUSTANG LINIK over the final 400 metres.
--Mr Puckett was present at the hearing of the Information and did not admit the breach.
--Mrs K R Williams, Stipendiary Steward, showed a video replay of the final 400m of the race. She pointed out MUSTANG LINK trailing the leader passing the 400m mark. From that point, Mr Puckett used the whip approximately 30 times Mrs Williams alleged, to just prior to the finishing line.
--Mr Puckett stated that he was trying to stay on the leader's back. It had been a "high speed race." He submitted that he had not struck the horse excessively and his actions were "very soft" and the horse was not marked. He further submitted that his whip use was not continuous and he had hit the horse with both reins as an alternative action. He also said that he had not been charged with a whip offence previously and he was only trying to hold his place in the race and was "struggling to keep up."
--The Committee was satisfied that the charge was proved. The number of strikes, approximately 30 over a distance of 350m is clearly excessive. Mr Puckett's explanations for his actions did not amount to a defence to the charge. The video replay spoke for itself that the use of the whip was excessive.
--Mr McIntyre confirmed that Mr Puckett had a clear record. He recommended a fine of $200.
--Mr Puckett submitted that he was not in a position to pay a fine.
--Mr Puckett's licence was suspended up to and including Sunday 17th September 2006.
