Stipendiary Steward Mr S Ching alleged that under Rule 871(1)(d) Mr D Bradley allowed his mount RHYTHM KING to shift outwards causing HILL TO HILL to check near the 1200 metres.
DECISION AND REASONS:
--Stipendiary Steward Mr S Ching alleged that under Rule 871(1)(d) Mr D Bradley allowed his mount RHYTHM KING to shift outwards causing HILL TO HILL to check near the 1200 metres.
--Video evidence was shown. Mr Minty riding ELLI MAE came across from wide out. The Stipendiary Stewards believed Mr Minty’s move was legitimate and he was not responsible for the incident. Video evidence showed Mr Bradley move out and cut off Mrs Williams. Side-on video of the same incident showed Mr Bradley’s move caused Mrs Williams to get into trouble and subsequently go backwards.
--In evidence, Mrs Williams said her position got tighter and tighter and she eventually ran out of racing room. Mrs Williams said Mr Bradley was about three-quarters of a length in front of her and Ms Anderson was about a head in front of her.
--In evidence, Mr Bradley said he thought Mrs Williams’ horse could have been pulling and that Mr Minty going across caused Mrs Williams to get squeezed. He said, “I came out to hold my line.” Also he felt Ms Anderson’s horse was rolling around on the wet track.
--Mr Ching said, referring to the video, Mr Bradley kept coming out and Mrs Williams was checked out of it.
--Mr Bradley said there were mitigating circumstances because Mr Minty came right across the field from wide out.
--In reply to Mr Bradley, Mr Ching said normally a horse coming across from wide out will drag a horse down but in this case Mr Bradley had moved out, not in.

Decision:
--We find that Mr Minty was clear when he came right across the front of the field and we agree with the evidence of Mr Ching that Mr Bradley moved out and took Mrs Williams line. We uphold the charge of careless riding.
--Penalty:
--Submissions as to penalty were heard. Mr Ching stated that Mr Bradley had not ridden for four months. He had a careless riding suspension of four days at Wellington on 19 January 2008 and a three day suspension for the same charge at Winton on 3 November 2007. He felt Mr Bradley had a reasonably good record and that this incident was in the medium to high range. He recommended a 4 to 6 day suspension. It was agreed that Mr Bradley rides everywhere he can throughout New Zealand.
--Mr Bradley felt he should not have had the charge upheld as several riders were involved, but said if he was to be suspended it should commence immediately.
--Mr Bradley’s licence was suspended from the end of racing at Waipa on the 30th July 2008 (engagements have closed for this meeting) up to and including Matamata on the 7th August 2008 – 5 days.
