Following race 9 an information was lodged pursuant to Rule 871(1)(d) when it was alleged by the informant, Chief Stipendiary Steward Mr R Sanders that Ms Spratt committed two breaches of that rule.

1st CHARGE:

--

 It was alleged that Ms S Spratt permitted her mount VICKEZZCHARDONAY to shift outwards near the 300 metres resulting in TINSELTOWN (C Grylls) being checked and shifting out making contact with PRIZE LADY (M Sweeney)

2nd CHARGE:

--

 As a result of the 1st particular PRIZE LADY makes contact with YOUNG CENTAUR (M Walker) which shifted out resulting in CASA DE CAMPO (M Du Plessis) clipping heels and falling with WILLY SMITH ( L Innes) checked as a consequence.

Ms Spratt admitted the 1st charge but denied the 2nd charge.

1st CHARGE

Mr J Oatham demonstrated the videos.  As the field rounded the home turn into the straight VICKEZZCHARDONNAY (S Spratt) was on the rails. Outside her was TINSELTOWN (C Grylls), PRIZE LADY (M Sweeney), YOUNG CENTAUR (M Walker) and CASA DE CAMPO (M Du Plassis).Ms Spratt could be seen to leave the rails and move out from behind DANCING FOREVER to find a gap. As she did so she took the line of TINSELTOWN and Mr Grylls was seen to check his mount. This movement took Ms Spratt to four off the rails.

As Ms Spratt had admitted the charge the committee is required to adjudicate on penalty only.

It was agreed that the 2nd charge which Ms Spratt had not admitted would be heard before any penalty was considered.

Mr Oatham demonstrated the video. He showed PRIZE LADY and YOUNG CENTAUR racing in the middle of the track and YOUNG CENTAUR making sharp outward movement. The result of this movement was that CASA DE CAMPO had no where to go and clipped heels and fell with further interference to WILLY SMITH.

Mr Sweeney (PRIZE LADY) said that on straightening up there was interference on his inside which forced Mr Grylls to check his mount.  This movement put pressure on to PRIZE LADY who was forced across on to YOUNG CENTAUR.

Mr Walker rider of YOUNG CENTAUR said he received contact from PRIZE LADY on his inside.  He said YOUNG CENTAUR was getting tired and he was made to roll out into the path of CASA DE CAMPO who clipped heels and fell.  Mr Walker said that if YOUNG CENTAUR had been going well enough he would have kept clear of CASA DE CAMPO and there would not have been a problem.

Ms Spratt asked Mr Walker if his horse was moving around.  Mr Walker agreed that he was and said that he was being a hindrance to all around.

In her defence Ms Spratt said that she did not believe that she was the cause of the fall.  She said that PRIZE LADY and YOUNG CENTAUR could be seen to move in. She claimed that tiredness made YOUNG CENTAUR roll out after his initial inward movement.

In summing up Mr Sanders said that both Mr Sweeney and Mr Walker had said that they had made contact due to pressure from the inside.  Mr Sanders submitted that YOUNG CENTAUR’s tiring was only a small part of the contribution to the reason for the interference to CASA DE CAMPO. He maintained that Ms Spratt’s careless riding resulted in Mr Du Plessis’ accident.

DECISION

The committee spent considerable time reviewing the evidence, particularly the head on and rear view videos.

--

 

--

It is the observation of the committee, after viewing the videos in a frame by frame movement that in the 2 strides before the alleged contact between PRIZE LADY and YOUNG CENTAUR the only side movement was from YOUNG CENTAUR.  This movement was inwards.  It is the committee’s view that PRIZE LADY did not make any appreciable outward movement and they could not see any visual contact between the two horses being made.  It is accepted that both riders said that contact had been made between their mounts but the observation of the committee is that any such contact was slight.  If indeed there was contact between PRIZE LADY and YOUNG CENTAUR there is doubt that YOUNG CENTAUR could have been turned out to such a degree.

Ms Spratt has earlier admitted a charge of causing interference to TINSELTOWN with resultant interference to PRIZE LADY.  The 2nd charge was that as a consequence of this interference PRIZE LADY was then forced into the line of CASA DE CAMPO causing that horse to fall.

The committee finds that this charge has not been proven and is therefore dismissed.

PENALTY SUBMISSIONS:

Ms Spratt asked that any suspension begin after racing on 7 March as she had no commitments after that.  She had tentative engagements to ride CULMINATE and GALLEONS REACH in Sydney on 21 March and MUFHASA also in Sydney on 4 April.

Mr Sanders gave Ms Spratt’s record.  He told the committee that the Auckland Cup was one of the flagships of N Z racing.  He did say that, in his opinion, although serious he did not believe that this offence was of the same degree as the 2 charges that were related to the running of the recent N Z Derby.  He asked for a suspension of 3-4 weeks and a fine of $1 – 2000.

 The committee carefully considered all submissions and took into account the following before imposing penalty.

1.         Ms Spratt’s guilty plea.

--

 

--

2.         Her improved riding record.

--

 

--

3.         The status of the race being Group 1 and the implications of Rule 1122, namely the consequences.

--

After due consideration Ms Spratt is suspended from race riding beginning after racing on 7 March and concluding on 31 March 2009.   In addition a fine of $1500 is imposed.
