Following Race 3 an information was lodged alleging a breach of Rule 869 (a) in that Mr A J Pyers, driver of KOZAROZA drove in a manner likely to interfere with his own horse and/or any other horse or its progress after approximately 150 metres had been covered.

Following Race 3 an information was lodged alleging a breach of Rule 869 (a) in that Mr A J Pyers, driver of KOZAROZA drove in a manner likely to interfere with his own horse and/or any other horse or its progress after approximately 150 metres had been covered.  The breach was not admitted.

Stipendiary Steward  Mr S P Renault showed the available films and pointed out Mr Pyers’ inward movement which caused Miss Chilcott’s horse to break after locking wheels with KOZAROZA, ending up at the back of the field.  He confirmed that Mr Pyers did pull off but he believed too late as the damage had been done.  Mr Pyers felt Miss Chilcott’s drive did come out a little and that any movement from him was marginal.  He believed he held his line well.  In answer to a question from Mr Taumanu, he agreed that he was in front of Miss Chilcott’s horse.

DECISION & REASON
The Committee, after viewing the available films, found the charge proven.  We believe that Miss Chilcott was entitled to be where she was and was behind KOZAROZA when the inward movement from that horse caused her horse to break.

SUBMISSIONS ON PENALTY
Mr Taumanu told the Committee this was Mr Pyers’ first charge under the rule and asked for a monetary penalty of $250.
Mr Pyers asked the Committee to impose a penalty of suspension for the breach.  Monetary considerations dictated his request.

DECISION
Mr Pyers, we have agreed to your request to impose a period of suspension for the breach.  You are suspended from racing from the completion of racing today 01 November until the completion of racing on 12 November 2009 (3 North Island days suspension).
