Decision:

An Information was filed pursuant to Rule 871 (1) (d), where it was alleged by the informant Stipendiary Steward, Mr Goodwin, that R Stam, rider of KING KEI, shifted out near the 200m mark when not clear of TOM THUMB



An Information was filed pursuant to Rule 871 (1) (d), where it was alleged by the informant Stipendiary Steward, Mr Goodwin, that R Stam, rider of KING KEI, shifted out near the 200m mark when not clear of TOM THUMB (P Taylor) which had to be checked.

Mr Stam admitted to breaching the rule.

Mr Goodwin, Stipendiary Steward, demonstrated the video films and showed when soon after turning for home, near the 200m mark, Mr Stam running alongside the rail looked to move out and executed the move, and in doing so took the line of TOM THUMB resulting in a check.

Mr Stam admitted moving out, however suggested his mount over-reacted and exaggerated his position.

--

Mr Goodwin disclosed Mr Stam's record "which was not good" and subsequent submission on penalty, suggested a suspension.

Mr Stam stated the majority of his riding engagements were local and he did not travel out of the region.

The Committee considered all submissions including the video footage and taking into account Mr Stam's guilty plea and his honesty with regards to his record. Accordingly, the Committee has imposed a suspension to start after the conclusion of racing on 10th December 2006 and finish after the conclusion of racing on 23rd December 2006 (3 riding days including one premier day).
