Following the running of Race 10, Wai-Eyre Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainer, Mr S R McNally, alleging a breach of Rule 864 (2) (d) in that “as the trainer of JAYZ MACHINE [he] failed to correctly affix the near side front hopple carrier so as not to come adrift”.

Following the running of Race 10, Wai-Eyre Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainer, Mr S R McNally, alleging a breach of Rule 864 (2) (d) in that “as the trainer of JAYZ MACHINE [he] failed to correctly affix the near side front hopple carrier so as not to come adrift”.
--Rule 864 (2) (d) provides as follows:
(2) Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that:-
(d) all gear is correctly applied and/or affixed so as not to malfunction or come adrift.
Mr McNally had signed the Statement by the Defendant endorsed on the information form indicating, firstly, that he admitted the breach of the Rule and, secondly, that he did not wish to be present at the hearing of the information. The charge was found proved accordingly.
--Mr Renault informed the Committee that JAYZ MACHINE “stepped out of” its front hopple which had come adrift from the carrier. The allegation of the Stipendiary Stewards was clearly demonstrated on a video replay. Mr McNally took the horse clear of the field and it was pulled up near the 600 metres.

Mr Renault said Mr McNally had not previously breached the Rule. He recommended a fine of $100.
Mr McNally was fined the sum of $100.
