DECISION AND REASONS:
Following the running of Race 3, BNZ Partners Rating 70, Information No. 41944 was filed by Stipendiary Steward, Mr M R Davidson, seeking a ruling as to whether ONE CHANCE (S Muniandy) was denied a fair start and requesting that the horse be declared a non runner.
Rule 632 provides as follows:
If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.
Mr Davidson informed the Committee that ONE CHANCE had been the favourite for Race 4. He showed video replays of the start of the Race. He pointed out ONE CHANCE, drawn at barrier 1 at the 1500 metres start. He submitted that it could be clearly seen that a barrier attendant was standing beside the horse on the gate and holding the horse’s bridle. The horse was fractious but was still being held by the barrier attendant. It was in the air with the attendant still holding it when the gates opened, he said. The horse had lost at least 2 lengths and had come out of the barrier last. In its last two starts, the horse had either led or raced 2nd in the running, Mr Davidson said. The Committee noted that ONE CHANCE had not finished in the first 6 placings in the 12-horse field.
--Mr Muniandy said that he had told the barrier attendant to leave the horse alone. He confirmed that the barrier attendant had been holding on to the rein when the gates opened. He said that, but for the attendant holding on to the rein, he had “no problem at all”. Mr Muniandy confirmed that the horse was an on-pace runner and was a fast horse out of the gates.
--The Committee was satisfied, from the video evidence and the submissions of Mr Davidson and the evidence of Mr Muniandy, that ONE CHANCE was denied a fair start and that its chances were materially prejudiced as a result. The Committee found that the horse was not slow away by its own accord.
--It was appropriate that ONE CHANCE be declared a non-runner in the Race and the Committee exercised its discretion to declare the horse a non-runner accordingly.
