An information was filed prior to race 8 under Rule 508(2)(5) when it was alleged by Mr Oatham, Stipendiary Steward, that Mr C R McCarroll, trainer of SANTOYA, failed to declare a rider by the required time.
| -- DECISION & REASON: --An information was filed prior to race 8 under Rule 508(2)(5) when it was alleged by Mr Oatham, Stipendiary Steward, that Mr C R McCarroll, trainer of SANTOYA, failed to declare a rider by the required time. Mr McCarroll pleaded guilty to the charge. ----Mr Oatham stated that Mr McCarroll only declared a rider at 9.30 am on race day when the rider should have been declared by 4 pm Thursday prior to race day. Mr Oatham said Mr McCarroll made no effort to contact either the Club or himself informing them of the reasons he had failed to declare a rider. ----Mr McCarroll said he had trouble finding a suitable rider and was hoping there would be a scratching therefore releasing a prominent rider. He did admit he had engaged a rider but admitted he should have informed the Club. ----PENALTY: --The Committee took into account these submissions and Mr McCarroll's guilty plea. However, we believe that given the status and the extreme lateness of the declaration the breach deserves a higher penalty than normal under this rule. Accordingly we impose a fine of $200. ------ --
