Following the running of Race 2 Stipendiary Steward Mr J MUIRHEAD laid an Information instigating a protest on behalf of horse 9 CADILLAC LAVROS (T HERLIHY) placed 6th against horse 4 ANZEURO (T SHAW) placed 2nd by the Judge.

----Following the running of Race 2 Stipendiary Steward Mr J MUIRHEAD laid an Information instigating a protest on behalf of horse 9 CADILLAC LAVROS (T HERLIHY) placed 6th against horse 4 ANZEURO (T SHAW) placed 2nd by the Judge, on the grounds of interference which occurred with approximately 400 metres to run
--Despite a request neither of the horses connections were present for the hearing and both drivers appeared
--Mr Muirhead gave evidence of his observations describing Mr Herlihy moving 2 wide to 3 wide with Mr Shaw outside. From his point it appeared initially that Mr Herlihy was entitled to make the move and he sounded the siren initiating a protest accordingly
--He then referred to videotapes of the relevant part of the race to support his contention. The quality of the tapes did not provide support for either drivers or Mr Muirheads interpretation of the event.
--Stipendiary Steward Mr Taumanu submitted that the protest had been instigated by the Stipendiary Stewards in order that the matter be decided by the Panel but indicated if the protest were to continue that it would more properly be the domain of Mr Herlihy, and agreed the video evidence did not support the protest.
--Mr Herlihy said he was disappointed with the actions of Mr Shaw as he considered he was entitled to move out but that he would not have protested.
--Mr Shaw maintained that he had merely held his line and that Mr Herlihy had tried to move into a gap that was never sufficiently wide to allow his progress.
--Decision
--The action taken by Stipendiary Steward Mr Muirhead in sounding the siren to initiate a protest hearing was justified. The evidence he gave could not be supported because of the poor quality of the video evidence and the diverging accounts of drivers Messrs Herlihy and Shaw.
--Accordingly I find there is insufficient proof to establish Mr Shaw improperly caused interference and the Protest is dismissed. The Judges placings will stand
