Following the running of Race 2, New Commercial Hotel Trot, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against GOOD CHARLOTTE (D D McCormick), placed 3rd following the disqualification of MONARO MISS from 3rd placing, on the grounds of breaking from its gait with 2100 metres to run and 500 metres to run.

DECISION AND REASONS:
--Following the running of Race 2, New Commercial Hotel Trot, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against GOOD CHARLOTTE (D D McCormick), placed 3rd following the disqualification of MONARO MISS from 3rd placing, on the grounds of breaking from its gait with 2100 metres to run and 500 metres to run.
--Mr McCormick, part-owner, trainer and driver of GOOD CHARLOTTE, appeared at the hearing of the information.
--Mr B R Willians, Assistant Stipendiary Steward, showed video replays of the relevant parts of the race. Mr Williams pointed out GOOD CHARLOTTE break from its gait with approximately 2100 metres to run when racing on the outside of and behind the then leader, MONARO MISS, which also broke. The horse continued in a gallop for a distance before regaining its proper gait. Mr McCormick submitted that the breaking of his horse was a consequence of interference from the breaking MONARO MISS.
--Mr Williams then pointed out GOOD CHARLOTTE, with approximately 500 metres to run, break and continue in a gallop for approximately 70 metres. Mr Williams alleged that the horse had failed to lose ground in the break.
--Mr Escott sought disqualification of MONARO MISS from the race.

Mr McCormick did not dispute that GOOD CHARLOTTE had galloped for 70 metres at the 500 metres but he denied that it had failed to lose ground by the break.
--The Committee was not satisfied that grounds for relegation or disqualification of GOOD CHARLOTTE had been made out by the Informant in respect of that horse's breaking with 2100 metres to run. However, in relation the breaking from its gait with 500 metres to run, the Committee was satisfied that GOOD CHARLOTTE:

- broke from its gait; --
- failed to promptly regain its proper gait in that it galloped for a distance of 70 metres; --
- failed to lose ground by the break; and --
- gained an advantage.
The Committee was satisfied that GOOD CHARLOTTE should be disqualified from the race and, accordingly, the protest was upheld and GOOD CHARLOTTE disqualified.
--Consequent upon the disqualification, the amended placings for the race are as follows:
--1st 13 Starwood in Aspen
--2nd 5 Love Hate Revenge
--3rd 11 Mentor
--4th 12 Shezadorabil
--5th 3 Coco Kid
