After the conclusion of Race 7, the Ryal Bush Transport and Justice Prevails Handicap, under Rule 871 (1) (d) an information was lodged by Stipendiary Steward Mr S Ching alleging that Ms T Newton, rider of DEWOFTHESEA, allowed her mount to shift ground outwards hampering and forcing MACINALLY, ridden by D G Bradley, and FASHION LYNNIE, ridden by R Bishop, over extra ground near the 250 metres.

Miss Newton did not admit the alleged breach.

Stipendiary Steward Mr Davidson used the head-on and side-on video clips of the alleged interference, highlighting in his opinion DEWOFTHESEA moving outwards off the running line when not clear of the horses racing on its outside, MACINALLY and FASHION LYNNIE.

Mr Bradley, rider of MACINALLY, stated that Miss Newton had moved out, effectively pushing him out, and in turn pushing out FASHION LYNNIE. Mr Bradley said that Miss Newton had made an error of judgement in that she was not sufficiently clear.

Miss Newton stated that she had enough room and was clear, and that Mr Bradley did not ‘call out’ that he did not have enough room.

The Committee upheld the charge suspending Miss Newton from the conclusion of racing on 23 November 2007 up to and including 7 December 2007.

The Committee was of the opinion that Miss Newton had clearly moved off the running line pushing MACINALLY and FASHION LYNNIE over extra ground, when not clear. The video evidence and Mr Bradley’s evidence was conclusive in our opinion and clearly Miss Newton has made an error of judgement.
