Following the running of race 9, the Nelson Pine Industries Mobile Pace, an information was lodged against Mr J Rogers, the driver of horse no. 9, SHEZE PURRFECT, alleging a breach of Rule 857 (7) (g) in that he failed to maintain his correct position behind the mobile gate.

Following the running of race 9, the Nelson Pine Industries Mobile Pace, an information was lodged against Mr J Rogers, the driver of horse no. 9, SHEZE PURRFECT, alleging a breach of Rule 857 (7) (g) in that he failed to maintain his correct position behind the mobile gate.
Mr Rogers denied the breach.
--Presenting his evidence, Mr Renault said that Mr Rogers (on SHEZE PURRFECT) drew the outside of the mobile start but he failed to maintain his position. He said Mr Rogers was on the barrier about 100 – 150 metres before the start but, at dispatch, was 1 to 2 lengths off it, and he then moved down and took his place in the running.
--Mr Ydgren was then invited to show the video of the start. He showed Mr Rogers up on the outside of the track up in position behind the mobile where he should have been. However, just before the start, he drifted back off the mobile gate and was about a length off at dispatch.
--Mr Renault concluded by saying the horse was pacing fluently, and Mr Rogers showed no attempt to run the horse along or use his whip to ask the horse to improve his position to the gate.
--In response, Mr Rogers said he simply couldn’t see, and he thought it was the right thing to do when he couldn’t see properly. He said the (weather) conditions were atrocious, there was wet grit coming up off the track, and it got both goggles, and he thought, in the circumstances, it was dangerous.
--Mr Rogers stated that it was not his style to pull back off the gate, particularly with that horse and, referring to the video, he asked the committee to note the other points in the race where he also dropped off the horse in front because it was impossible to see. He also said he had explained this to the stewards.

RESUMPTION
When the hearing resumed, the parties were advised that the committee was dealing solely with the matter of the Information that was before it and, in relation to other unrelated matters introduced by Mr Rogers, he was spoken to advisedly.
DECISION AND PENALTY
Mr Rogers appears on an alleged breach of Rule 857 (7) (g), in that he failed to maintain his correct position behind the mobile gate.
We have seen a video of the race which showed the start and, just prior to the start, Mr Rogers drifted back on his horse, no 9, SHEZE PURRFECT. That is not contested.
--The videos showed that he was in position until just prior to the mobile gate moving away and, when it did so, and the green light came on, he had drifted back marginally behind another horse.
--Mr Rogers indicated it was because of grit, or mud, in the eye that prevented him from maintaining his position.
--We consider there may have been other options rather than drifting off the gate that prompted this charge – such as moving a fraction wider, or calling out, or perhaps some other option the driver may determine at the time – but we acknowledge Mr Rogers’ explanation that he had difficulty seeing which, he said, also occurred elsewhere in the race.
--We also note that, in drifting back off the gate, when the purpose may be to obtain a beneficial position in the running, Mr Rogers ended up well back in the field behind the majority of runners, and he gained no advantage.
--It is, however, a breach of strict liability and we do find that Mr Rogers did not maintain his position behind the mobile gate. Accordingly, we find the charge proved but, whilst it is subject to a monetary penalty, taking into account the conditions, and Mr Rogers’ explanation, we are prepared to impose no penalty in this particular case.
