Decision: Prior to Race 11 an Information was filed pursuant to Rule 520 (4) (C). The Informant Mr M Williamson said that Mr M Cropp, rider of Good Call in Race 11 failed to make the agreed weight for his mount.

Prior to Race 11 an Information was filed pursuant to Rule 520 (4) (C). The Informant Mr M Williamson said that Mr M Cropp, rider of Good Call in Race 11 failed to make the agreed weight for his mount.  Mr Cropp admitted the breach and was represented by Trainer Mr G McCrae.  Mr Williamson said that Mr Cropp’s NZTR agreed weight had been raised to 56kgs and in this case the carded weight was 55 ½ kgs which the Trainer of Good Call, Mr L Sommervell, had agreed to.  However Mr Cropp weighed out at 57 ½ kgs which Mr Sommervell did not agree to and subsequently scratched the horse as a suitable rider could not be engaged.

Mr Cropp said Mr Williamson had stated the true course of events and had nothing further to add.

PENALTY SUBMISSIONS

Mr Williamson said Mr Cropp should have informed the Stewards when he knew early in the day he could not make the weight.  He said Mr Cropp had been charged with the same offence on 21 September 2008 when he was fined $150 and submitted this time he should be fined $200 - $300.

Mr Cropp had nothing to say and Mr McCrae said Mr Cropp had done his best.

The Committee considered all submissions and evidence as presented.  It was explained to Mr Cropp his obligations under the Rule and to Owners and Trainers alike.  Before imposing a penalty we took into account this was Mr Cropp’s second breach in the last month under this rule..  Accordingly we impose a fine of $250.
