Decision: --

Following the running of Race 1 Stipendiary Steward Mr S. C. Ching charged Jockey B. Ropiha under Rule 520(4)(c) with allowing himself to be engaged to ride the horse "Miss Moss" at 63kg, but upon being weighed out was 64.5kg being 1.5kg in excess of the carded weight. This charge was dealt with and Mr Ropiha was suspended for 2 days. At the time of that hearing it was also raised that Mr Ropiha had a ride in Race 8, and that he would very likely be 2.5kg overweight for that race. It was also discussed whether Mr Ropiha should be dealt with for both breaches at the same time. Our decision was that the Race 8 breach should be dealt with separately.

DECISION AND REASONS:

Following the running of Race 1 Stipendiary Steward Mr S. C. Ching charged Jockey B. Ropiha under Rule 520(4)(c) with allowing himself to be engaged to ride the horse "Miss Moss" at 63kg, but upon being weighed out was 64.5kg being 1.5kg in excess of the carded weight. This charge was dealt with and Mr Ropiha was suspended for 2 days. At the time of that hearing it was also raised that Mr Ropiha had a ride in Race 8, and that he would very likely be 2.5kg overweight for that race. It was also discussed whether Mr Ropiha should be dealt with for both breaches at the same time. Our decision was that the Race 8 breach should be dealt with separately.

Following the running of Race 8, the 116th Grand National Hurdles Handicap, Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 520(4)(c) alleging Jockey B. Ropiha allowed himself to be engaged to ride the horse "High Season" at 62kg, but that he would have been 2.5kg in excess of the carded weight had he ridden that horse.

Rule 520(4)(c) reads as follows.

"(4) Every Rider commits a breach of these Rules who:

    4. wilfully or without reasonable cause permits himself to be engaged to ride a horse when he knows or ought to know that he will not be able to ride the horse at the weight which it is handicapped to carry or such other weight at which he agrees to ride the horse."

Mr Ropiha agreed that he understood the rule and the charge. He had indicated on the information that he admitted the breach of this rule, and he confirmed this at the hearing.

Stipendiary Steward Mr S. C. Ching gave evidence that Mr Ropiha had approached him about half an hour before the first race to advise that he was going to be 1kg over for that race. It was later established that he was in fact 1.5kg overweight. It also became known that Mr Ropiha would be about 2.5kg overweight for his ride in Race 8. It was therefore necessary to find a replacement rider for "High Season" that Mr Ropiha was to ride in that race.

Mr Ropiha had nothing further to add to the evidence he had already given at the earlier hearing, and he again asked that he be given a suspension instead of a fine. Mr Ching agreed that a period of suspension was an appropriate penalty in this case.

We adjourned to consider the matter of penalty.

Penalty: In relation to penalty we were satisfied that this breach is relatively serious in that Mr Ropiha had to be replaced as the rider in what was a Prestige Jumping Race. On returning to the Enquiry Room we advised that a full written decision would be given later and we gave the following oral decision.

"Mr Ropiha we have taken into account that there was a connection between this charge you are now facing and the one you faced earlier, and that your weight has not changed between races. So there was that connection. But the race that you are involved in here (Race 8) was a Prestige Jumping Race. We also must take that into account, and there was an effect on the connections of the horse. So our penalty we have decided is to add another two days suspension to the two you are already serving, which will take you up (to after) the completion of racing on the 27 August 2005."
