An information instigating a protest lodged by Stipendiary Steward Mr J Muirhead on behalf of ALLCLOUT driven by Mr P Ferguson placed 4th, against SPIRIT OF ADONIS driven by Mr I Brownlee placed 3rd, on the basis of a breach of the Push Out Rule 1200 m from the finish of the race.
--Mr Brownlee represented the connections of SPIRIT OF ADONIS and Mr Ferguson the connections of ALLCLOUT.
--Mr Muirhead showed the video films of the incident. He said he believed the films showed there had been a breach of the Push Out Rule. However, none of the films were able to show with precision whether or not Mr Muirhead’s opinion was correct or not.
--Mr Ferguson said that the nose of his horse was past the rear of the sulky wheel of Mr Brownlee’s horse at the time Mr Brownlee moved outwards. Mr Brownlee was adamant that he had not breached the Push Out Rule. The film actually shows that Mr Brownlee looked to his left prior to moving his horse outwards. The evidence left me in a state of considerable doubt and my own view was that it was more likely than not from the viewing the films that there had in fact been no breach of the Push Out Rule. Accordingly I dismissed the protest.
