Following the running of Race 2, the Shoreline Motel Napier 1400m, Mr. J. Waddell lodged a protest under Rule 642 (1) alleging that BRAZEN or its rider placed 1st by the judge caused interference to CHUNKMEISTER placed 2nd by the judge.
Following the running of Race 2, the Shoreline Motel Napier 1400m, Mr. J. Waddell lodged a protest under Rule 642 (1) alleging that BRAZEN or its rider placed 1st by the judge caused interference to CHUNKMEISTER placed 2nd by the judge. The interference occurred over the concluding stages.
--The Judge’s placings were:
--1st No. 9 BRAZEN
2nd No. 10 CHUNKMEISTER
3rd No.16 PEARL DANCER
4th No.15 OUR DREAM CATCHER
The margin between first and second was a short head.
--The information was filed with the registrar within the time prescribed.
Present at the enquiry were Mr. Jason Waddell and Mr. Andrew Campbell representing CHUNKMEISTER and Mrs. Michelle Wenn represented the connections of BRAZEN. All parties were notified of the protest but Mrs. Jeanann Hercock the trainer of BRAZEN was attending to the horse and was not present.
Mr. Waddell showed the head-on film of the final stages of the race and explained the two occasions where contact took place and which he believed cost him the winning of the race.
--The first incident was prior to the 50 m mark when he alleged he was in front of BRAZEN when Mrs. Wenn allowed her mount to move inwards brushing his horse. While acknowledging that he did not have to stop riding Mr. Waddell said that he was prevented from riding with vigour.
The second incident occurred approximately three strides from the finish line. Mr. Campbell said that his horse was having its first start and was not a big or robust filly; consequently any interference would knock her around.
Mrs. Wenn described the contact as a very marginal brush and maintained that she was in front of Mr. Waddell at the time. BRAZEN was also a first starter and Mrs. Wenn said her momentum was equally affected. The second point of contact was too close to the line to count.
--Mr. Williamson was asked for the stewards’ interpretation of the incident. He said that while there was contact on two occasions over the concluding stages both horses had moved off their lines of running and contributed to the interference.
--Decision
--Rule 642 (1) states:
--If a placed horse or its Rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with.
--After listening to all the evidence and viewing the films the committee accepts that there was contact between BRAZEN and CHUNKMEISTER on two occasions over the concluding stages of the race.
--The first incident was regarded as the most significant however after slowing the films right down it was our opinion that as BRAZEN shifted inwards there was a slight simultaneous outward movement by CHUNKMEISTER.
--The second point of contact was too close to the finish line to have affected the result.
--We were not convinced therefore that BRAZEN was the sole cause of any interference. The protest was dismissed and placings allowed to stand as called by the judge.
