THE FACTS

--

As a result of an incident in Race 6 at the Canterbury Jockey Club’s meeting on Saturday 2 May 2009, the Selwyn River Stud Champagne Stakes, Ms L Allpress, Licensed Jockey, was charged with careless riding pursuant to Rule 871(1)(d) of the Rules of Racing.

It was alleged that near the 400 metres she forced a run between “Gold Tap” (R Bishop) and “Clapton” (O Bosson) where there was insufficient room and as a result, “Clapton” was forced out onto the heels of “Our Beejay” (J Todd) and had to be checked.

--

Mr Sanders, Chief Stipendiary Steward, called Licensed Jockey, Mr O Bosson, to give evidence.  Mr Bosson said his mount was pushed out from the inside on to the heels of “Our Beejay”.  He said that initially there was no room, but that his mount eased off a fraction and that there may have been room for a horse to improve in to the gap.

In cross examination, Ms Allpress asked Mr Bosson that if a gap had opened in the manner that she considered, would he have gone for it.  Mr Bosson agreed that he would have.

Mr Sanders then took the hearing through the video evidence from the rear on and side on views. 

--

He pointed to the incident which gave rise to the charge, and conceded that Mr Ryan Bishop on “Gold Tap” did move out, but was entitled to do so.  He said there was no clear running between the horses concerned.

In response, Mr Allpress pointed to the fact on the side on camera, that the run was clearly there, but that Mr Bishop’s outwards movement dictated her line.  She said she could clearly see her run, and that she was committed to it.

DECISION

--

In order for us to find the charge proved, we must be satisfied on the totality of the evidence that Ms Allpress rode carelessly.

--

In this case, the incident occurred when riders were riding keenly and looking for their runs to the winning post. 

--

We find as follows:

--

a) That there was contact between Ms Allpress’s mount and Mr Bosson’s mount;
b) We find as a fact that Ms Allpress’s mount was partially in the gap that she was angling for;
c) Mr Bishop did move outwards at a critical point, when Ms Allpress was aiming for the gap. 

--

Having regard to these findings, we cannot be entirely satisfied that Ms Allpress directed her mount outwards in a manner which would constitute careless riding.  She was in a gap which tightened as a result of Mr Bishop’s outward movement. 

--

From that point on, there was a concertina effect, as a result of having her line dictated, albeit for a very short distance.

--

Because we are not entirely satisfied, the charge is dismissed.
