Following Race 2 an information was filed pursuant to Rule 871(1)(d), when it was alleged by the Informant, Mr C George, that near the 900 metre mark Mr O Bosson, rider of BELTHAZAR, permitted his mount to shift in when not clear of FORREST

DECISION AND REASON:
--Following Race 2 an information was filed pursuant to Rule 871(1)(d), when it was alleged by the Informant, Mr C George, that near the 900 metre mark Mr O Bosson, rider of BELTHAZAR, permitted his mount to shift in when not clear of FORREST (L Allpress) which was crowded and checked and in turn crowded PINMDOWN (D Walsh) which resulted in KAY?S AWAKE (A Calder) also being checked.
--Mr Bosson admitted the charge, which only necessitates the committee to determine a penalty.
--Stipendiary Steward, Mr J Oatham, demonstrated the video films which showed Mr Bosson on BELTHAZAR moving inwards near the 900 metre mark when not sufficiently clear of FORREST forcing that runner onto PINMDOWN, and that runner onto KAY?S AWAKE on the inside.
--Mr Bosson said that Ms Allpress missed the start slightly and rushed up quickly on his inside. He thought he was clear until that point. Regarding penalty he said he was starting a suspension after racing (7th) which concludes after racing on the 14th.
--Mr George said that although it was very careless on Mr Bossons part, the consequences were not great and was not at the higher end of the scale.
--He produced Mr Bossons record, which showed this to be Mr Bosson's third offence since the 6th September 2006.
--The committee considered all submissions and have taken into account Mr Bossons' guilty plea, his record and Mr George's submissions that the incident was not at the higher end of carelessness.
--Accordingly, the committee found that a suspension is warranted and imposed a suspension to start after racing on the 14th October 2006 and conclude after racing on the 21st October 2006. This suspension follows on from the suspension Mr Bosson begins after racing today (7th).
