Following the running of Race 1, trainer/driver Mr R Rochford appeared on a breach of Rule 847(1) in that he entered the birdcage and checked out without a safety vest.
Following the running of Race 1, trainer/driver Mr R Rochford appeared on a breach of Rule 847(1) in that he entered the birdcage and checked out without a safety vest. Mr Rochford admitted the breach.
----Explaining the circumstances, stipendiary steward Mr Ydgren said that, prior to the event, Mr Rochford was checked out and found to be not wearing a safety vest. He explained that wearing a safety vest is an extreme safety issue and, in this instance, it was not a case of not wearing an approved vest, but not wearing one at all.
----Whilst Mr Rochford has not appeared on such a charge, in referring to a previous case involving a regular driver at a premier meeting, Mr Ydgren recommended a penalty in the order of $500.00 which would act as a deterrent.
----Mr Rochford said he had no excuse. He said it was just an innocent mistake and he didn?t realise he didn?t have it on. In respect to penalty, he felt that $500.00 in the circumstances was harsh.

In this case, we accept that he doesn?t drive a lot, compared to those other drivers who drive regularly and naturally appreciate the safety vest as an everyday part of their kit. We accept this as an inadvertent mistake on his part in this instance, and we are going to treat the recommendation of the stipendiary steward as a guide in determining penalty. Taking the overall considerations into account and his open admission of the breach, Mr Rochford is fined the sum of $400.00.
