DECISION AND REASONS:
--An information was filed by Stipendiary Steward, Mr N Ydgren, against Licensed Trainer, Mr R J Dunn, alleging a breach of the Notification of Drivers Regulation in that Mr Dunn failed to notify drivers for the horses, both trained by him ? namely, FEARLESS HANOVER in Race 2 and MAJHAC MEDDLE in Race 9.
----Licensed Open Horseman, Mr R E Fensom, had signed the Statement of Defendant endorsed on the information form to the effect that the breach was admitted and that Mr Dunn did not wish to be present at the hearing of the information. The Committee was informed that Mr Fensom is the stable foreman for Mr Dunn.
----Mr Ydgren confirmed to the Committee that, although two horses were involved, the information was to be regarded as a single charge and only one penalty was being sought. He recommended a fine of $50.00. Mr Ydgren said that the recommended fine had been discussed with Mr Fensom.
----On the basis of Mr Dunn's admission of the breach through Mr Fensom, the charge was found to be proved and Mr Dunn was fined the sum of $50.00.
