DECISION & REASON:
Following race two an information was filed pursuant to Rule 638(1)(d).  The informant, Mr Coles, alleged that Mr J McDonald, rider of MIRAFLORES, angled his mount out when not clear of SUNDOWN (N Collett) causing that horse to check with a resultant check to SILK ROAD (C Ormsby).

Mr McDonald pleaded guilty to the charge.

--

Mr Coles demonstrated the video films which showed soon after passing the 200 metres Mr McDonald riding MIRAFLORES, angle his mount out for a run and in doing so take the line of SUNDOWN.  This caused Miss Collett to check her mount with a resultant check to SILK ROAD.  It was clear Mr McDonald was not the required distance clear of Miss Collett when moving out.

Mr McDonald said he was traveling well at the time, but admitted moving out and giving Miss Collett a little bump.

PENALTY SUBMISSIONS:
Mr Coles told the Committee that Mr McDonald had incurred four suspensions in the last 12 months:
15.4.09 – 6 days
8.7.09 – 4 days
11.11.09 – 4 days
14.11.09 – 8 days

However, he said this was a good record for the number of rides he has and believed this offence was at the lower end of carelessness.

Mr McDonald told the Committee that he had confirmed rides up to and including 31.1.10.

--

PENALTY:
The Committee considered all evidence and submissions as presented.  We concur with Mr Coles that Mr McDonald’s carelessness was at the low end and believe a four day suspension is appropriate. 

--

Mr Walker, trainer, informed the Stewards that he was happy to release Mr McDonald from his tentative engagements at Te Teko.

--

After learning this and considering that declarations had not closed the Committee imposes a suspension on Mr McDonald from riding in races which starts after racing on 31.1.10 and concludes after racing on 5.2.10 (four days).
