CHARGES:

At the conclusion of race 5 the Gore Septic Tank Cleaners 1355 a protest was lodged by Mr S Marr (Trainer of Inquisition)who was placed second by the judge alleging that Golden Spot (Miss S Evans) who was placed first by the judge interfered with Inquisition in the final straight.

The rule 642 (1) reads if a placed horse or it’s rider causes interference within the meaning of this rule to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred they may place the first mentioned horse immediately after the horse interfered with.

FACTS/SUBMISSIONS

--

Mr Marr stated that his horse Inquisition had been interfered with twice in the home straight by the outward movement of Golden Spot.” Every time my horse attempted to gain ground on Golden Spot he was impeded and lost about one and a half lengths’’.

Mr Marr then used the various video clips to highlight his evidence. Mr Marr also stated that the track was sticky and difficult to make ground up in.

--

Mr Botthamley (Inquisition) confirmed Mr Marr’s statements and added that he had to ease his horse off the heels of Golden Spot. Mr Botthamley also said his horse was traveling well in the home straight and making up ground well.

Mr Thompson (Owner/Trainer Golden Spot) said his horse had moved outwards but he believed that Mr Botthamley had not stopped riding his horse out. Mr Thompson also stated that Mr Botthamley’s horse had ducked in of its own accord.

Miss Evans (Golden Spot) said she could not see from the video evidence where Mr Botthamley had stopped riding his horse out.

--

Stipendiary Steward Mr Mc Laughlin stated that he believed the committee needed to consider whether or not Inquisition had enough ground to make up after the alleged interference in the home straight.

It was noted the margin between the first and second placed horses was one length.

--

DECISION:

--

The committee was satisfied that interference of a minor nature had occurred in the home straight at the 175 metre mark and the 75 metre mark from the winning post where Golden Spot had moved outwards.

--

The committee was also of the opinion that the interference was not sufficient to alter the judge’s placings and as a result the protest was dismissed.

--

 

--

The winning margin of one length was considered to be pivotal in the committee‘s decision and it was also considered that Inquisition had a significant length of the straight to make up any ground that may have been lost by any outward movement of Golden Spot.
