An information instigating a protest was lodged by Stipendiary Steward Mr T Taumanu against Super Max driven by Mr P Butcher placed 2nd by the Judge,on behalf of the horse Honneur France drivne by Mr T Mitchell placed 3rd by the Judge on the grounds of interference going into the first bend. Mr Butcher represented the connections of Super Max and Mr Mitchell those of Honneur France

Mr Taumanu described the incident supported by video film. He said that driver P. Butcher had been outside Mr Mitchell entering the first bend and had cut the apex of the turn causing Mr Mitchell to run out of room. This resulted in Mr Butcher having the trail instead of Mr Mitchell and thus improving his position.

Mr Butcher contended Mitchell had been slow to start and had improved inside of him near the first bend when there was insufficient room. Mr Mitchell contended that he had followed 1 Kai Clutha Clash (B Mangos) from the start and was tightened for room by Mr Butcher on the turn giving him insufficient room on the back of Mr Mangos and causing him to pull back.

DECISION AND REASONS

It was clear from the video film that Driver P Butcher had cut the apex of the first bend following the start of the race forcing Driver T Mitchell onto the pylons and thus causing interference. Video footage available did not support Mr Butchers contention and accordingly the protest was upheld resulting in the judges placing for the two horses being exchanged with Super Max (P Butcher)being relegated to 3rd behind Honneur France(T Mitchell)
