Following race 10 on the programme, an Information was lodged against trainer, Mr A Bull, alleging a breach of Rule 302(5)(a) in that he used an unregistered stablehand to assist at the race meeting.

Mr Bull was not present but was represented by his son, Mr Harry Bull, who signified on his father’s behalf that he admitted the breach and who, himself, elected not to be present at the hearing.

Mr Ching read the Rule and explained the circumstances of the case. He said that, prior to race 9, stipendiary steward, Mr M Humphries, was checking on registrations in the parade ring when he happened upon a Mr James McLean who was leading a horse trained by Mr Bull. When questioned, he admitted he was not registered.

The steward approached the trainer’s representative, Mr Harry Bull, who agreed that Mr McLean was not registered. When advised that he was required to be registered to lead the horses out, Mr Bull took over the leading of the horse. However, when Mr Humphries checked the following race, Mr McLean was again leading a Bull-trained horse, and the charge followed.

Mr Ching advised the committee that he then spoke on the phone with trainer, Mr Bull, and he understood the charge, and had his son represent him.

In respect to penalty, he indicated this was a first such breach by Mr Bull and he recommended a moderate monetary penalty, but one that would send a message to other trainers.

In this case, Mr A Bull, through his son, has admitted a breach of Rule 302(5)(a) in that he used an unregistered stablehand to assist at todays races. We have had the circumstances explained, and the stewards have recommended a penalty that may act as a deterrent.

We accept that this is Mr Bull’s first such breach but, in this case, there was also an aggravating feature in that we are informed the unregistered stablehand continued to lead the horses after being spoken to by the stipendiary steward. While this may have been in Mr Bull’s absence, he was assisting that stable. Considering other penalties that have recently been applied, and Mr Bull’s acknowledging the breach, we are satisfied a fine of $100.00 is appropriate.
