Following the running of Race 10, Vernon & Vazey Truck Parts Premier, an information was filed by Stipendiary Steward, Mr J P Oatham, against Licensed Jockey, Mr O P Bosson, alleging a breach of Rule 638 (1) (d) in that Mr Bosson, as the rider of ICESKATES in the Race, he “allowed his mount to shift in near the 300 metres when not clear of ALI GEE (R J Hannam) which was checked and went back on to HIT THE BIT (J R Todd) which was hampered”.

Following the running of Race 10, Vernon & Vazey Truck Parts Premier, an information was filed by Stipendiary Steward, Mr J P Oatham, against Licensed Jockey, Mr O P Bosson, alleging a breach of Rule 638 (1) (d) in that Mr Bosson, as the rider of ICESKATES in the Race, he “allowed his mount to shift in near the 300 metres when not clear of ALI GEE (R J Hannam) which was checked and went back on to HIT THE BIT (J R Todd) which was hampered”.

Mr Bosson was present at the hearing of the information and admitted the breach. The charge was found proved accordingly.

Rule 638 provides as follows:
(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
  (d)     careless.

--

Mr Oatham had Mr M R Davidson, Stipendiary Steward, show video replays, from three angles, of the incident near the 200 metres. Mr Bosson had allowed his mount to shift in and check Mr Hannam’s mount which, in turn, was forced into Mr Todd’s line.

--

Mr Bosson told the Committee that his mount had bad feet and wore stick-on shoes. When the pressure goes on, he tends to lay in. The trainer did not warn him of this tendency until after the Race. He admitted that he had “rolled in” a horse width.

Mr Oatham confirmed that the trainer of ICESKATES, Mr Rogerson, had confirmed to the Stewards post race that the horse had the tendency that Mr Bosson referred to and that he had omitted to tell Mr Bosson prior to the Race.

Mr Oatham informed the Committee that Mr Bosson had two breaches of the careless riding Rule in the past 12 months:
• 27.6.09    Hawkes Bay     4 days
• 12.9.09    Marton            4 days

Mr Bosson is one the country’s most successful jockeys and is riding at a number of meetings around the country. In the circumstances, his record was “reasonably good”. Today’s meeting was a premier day but Race 10 was only a Rating 75 race for a stake of $15,000.

Mr Oatham said that Mr Bosson had put his whip away and attempted to straighten his mount. He did continue to ride forward with hands and heels but he had taken some remedial measures. This was a mitigating factor, Mr Oatham submitted. The level of carelessness was in the low to mid range.

Mr Bosson said that he had engagements at the meeting of Taranaki Racing Club on 18 November.  He sought a deferment to enable him to carry out those engagements.

In determining penalty, the Committee took into account the following matters:
• Mr Bosson’s admission of the breach;
• His record which Mr Oatham described as “reasonably good”;
• The trainer had not warned Mr Bosson of the horse’s tendency to lay in under pressure; and
• That the level of carelessness was in the low to mid range.

--

Mr Bosson was suspended for the period 19 November 2009 to 25 November 2009, both dates inclusive. This period encompasses four meetings – Rotorua, Counties or Hawkes Bay, Cambridge and Te Aroha.
