Following the running of Race 8, The Washington VC Mobile Pace, an information instigating a protest was filed by Stipendiary Steward Mr C J Allison. The allegation being that over the final stages, WOODLEA FIRE (D J Dunn) shifted ground outwards impeding GLENGARRY SUNRISE (D J Butt).

Following the running of Race 8, The Washington VC Mobile Pace, an information instigating a protest was filed by Stipendiary Steward Mr C J Allison. The allegation being that over the final stages, WOODLEA FIRE (D J Dunn) shifted ground outwards impeding GLENGARRY SUNRISE (D J Butt).

WOODLEA FIRE finished first, with GLENGARRY SUNRISE running second. The losing margin being a neck.

Messrs Dunn and Butt were both present at the hearing..

Film of the incident was demonstrated by Stipendiary Steward Mr P Knowles, showing the incident occurring shortly after entering the home straight for the final time.

WOODLEA FIRE is racing in front, with GLENGARRY SUNRISE improving in the clear, wider on the track.
----
On straightening, WOODLEA FIRE in seen to commence a gradual drift outwards and into the line of GLENGARRY SUNRISE. This outward movement continued over a distance of at least 80 metres gauged from track markers passed and has forced GLENGARRY SUNRISE to race at least two cart widths wider than the clear line the horse had prior to the outward movement.

Once WOODLEA FIRE is straightened, GLENGARRY SUNRISE is observed to run on strongly to the finish.

Mr Butt stated that he was continuing to make ground at the finish and that he had been hampered by the outward movement from Mr Dunn’s horse. He stated that although he was still able to drive his horse with the whip, he still had to keep pulling his horse off Mr Dunn.

Mr Dunn conceded that he had drifted out, however it hadn’t stopped Mr Butt from driving his horse out.

Mr Allison referred to Mr Dunn’s obligations under the Home Straight Regulations which specify that in the home straight a driver must maintain as straight a course as possible to the finish line.
----
Having regard to Rule 869(8)(b) it is clear that Mr Dunn has interfered with the progress of Mr Butt and that this action having taken place over a distance of some 80 metres before being corrected has significance when relating it to the losing margin of Mr Butt’s horse being a neck.
----
In addition, the fact that Mr Dunn was leading into the straight, affords him no legitimacy to make any outward movement under the Home Straight Regulations which could act to mitigate his actions.
----
Accordingly, the protest is upheld, with WOODLEA FIRE being relegated to behind GLENGARRY SUNRISE.
