Mr Tither you?ve admitted a breach of rule 839(b) careless driving. I therefore find the charge proved. You have indicated you do not want the assistance of a senior horseman.

As Mr Allison has said, this was a breach of basic horsemanship in failing to give another driver the necessary room. You were unsuccessful in your attempt to get to the lead but continued to come across when you knew Mr Suddaby driving LANGLANDS was there and you were not clear of LANGLANDS. Even though Mr Suddaby had moved into the passing lane, you have driven enough times at Forbury to know the configuration of the track and that you needed to keep your horse out. There were safety issues involved and the incident extinguished the chances of 3 horses and the connections have lost out.

We view this breach as being towards the upper end of the scale. Mr Allison has asked for a 3 day suspension. You ask for less days and a fine. You point to your excellent record of no breaches in 45 drives this season, and Mr Allison has confirmed that you are one of the South's leading junior drivers. You also state that there is not a large number of junior drivers available for such races in the South. You have conducted yourself in a very professional fashion in the room and you have readily admitted the breach and appear genuinely remorseful.

You are suspended from the end of racing at Geraldine on Saturday December 2 up to and including December 10. You are also fined the sum of $250, with $150 to the connections of IMPERIAL SPIRIT under rule 1114(2A). They have lost the 2nd place purse of $1200 as a consequence of the disqualification of IMPERIAL SPIRIT due to your actions. We do not have the power to forfeit your driving fee. The $150 will go some way to recompensing the owners for your fee and the costs of the horse travelling to Forbury.
