Mr McMahon, the driver of FLASHING RED, placed 4th by the Judge protested against LONDON LEGEND, placed 3rd, alleging interference, contrary to Rule 869(8) in the run home.
| -- Mr McMahon, the driver of FLASHING RED, placed 4th by the Judge protested against LONDON LEGEND, placed 3rd, alleging interference, contrary to Rule 869(8) in the run home. Mr McMahon stated that LONDON LEGEND impeded him by moving inwards over the last 100m or so. He said there were two incidents. The most significant was when LONDON LEGEND moved in at the 50m mark. He stated that his sulky wheel was on the inside of LONDON LEGEND and his horse's progress was impeded as he was jammed up between LONDON LEGEND and the horse on his inner. Mr McMahon stated that his horse had kept a straight line to the winning post. He also stated that there was contact between the wheels of the carts about 100m out, as LONDON LEGEND moved in. He emphasised the margin between 3rd and 4th was only a neck. ----Mr Jones initially denied moving inwards but later said if he had moved in, he had done so marginally. He said Mr McMahon had moved out. He stated that shortly after turning for home FLASHING RED had moved out. He stated he was not aware that the wheels of the carts had touched. Mr Wakefield, owner of LONDON LEGEND, stated the incident was a result of FLASHING RED moving out into the line of LONDON LEGEND. ----Mr Muirhead, Stipendiary Steward, said it was a matter of whether LONDON LEGEND had kept a straight line in the straight. ----Decision and Reasons: ----We are satisfied after viewing the videos and listening to the evidence as presented that as the field swung for home FLASHING RED was the leading horse. It was observed from the head-on video that FLASHING RED was racing approximately 1-1/2 cart widths off the marker line making the turn into the straight, causing LONDON LEGEND, which was racing on its outside, to cover a minimal amount of extra ground. That horse was approximately half a length back from FLASHING RED. We are satisfied there was inward movement by LONDON LEGEND in the last 100m and that there was contact between sulky wheels. FLASHING RED fought back but the horse's progress was impeded because there was no room for it to improve. The video supports Mr McMahon's statement that he was jammed between LONDON LEGEND and the horse on his inner. We are satisfied there was interference as a consequence of the inward movement of LONDON LEGEND. FLASHING RED?S chances and progress were impeded by that horse. The margin was only a neck. In these circumstances we exercise our discretion under Rule 869(8) and relegate LONDON LEGEND to behind FLASHING RED. ----Amended placings are: --
