Decision:
Following the running of Race 7, the Continentalman Handicap Trot, an information was filed by Stipendiary Steward Mr S. P. Renault against Mr J. W. Smith, Open Horseman, alleging a breach of Rule 869(2)(a), in that he used the whip excessively in the run home whilst driving his horse “Perfect For Now” (15).

Following the running of Race 7, the Continentalman Handicap Trot, an information was filed by Stipendiary Steward Mr S. P. Renault against Mr J. W. Smith, Open Horseman, alleging a breach of Rule 869(2)(a), in that he used the whip excessively in the run home whilst driving his horse “Perfect For Now” (15).
--Mr Smith had indicated on the information that he admitted this breach of the Rules, and he also agreed that he understood the charge and the Rule it was brought under. The charge was found to be proved accordingly.
--Mr Renault used video coverage to show that Mr Smith had used his whip on about 20 occasions in the run home. In explanation Mr Smith said that his horse was close to paying a dividend (it finished 5th), and that it was well backed.
--Penalty:
--Mr Renault advised that Mr Smith had no relevant previous convictions, and recommended a fine of $200-00. Mr Smith had nothing to say regarding the recommended penalty. We were satisfied that the fine recommended was appropriate in this case, and accordingly Mr Smith was fined the sum of $200-00.
