--This hearing is the result of an adjourned hearing from the Invercargill Harness Racing Club on 23 August 2009. The re-convened hearing took place at the Winton Harness Racing Club, on Friday 18 September 2009, at 11:30 am, prior to the commencement of the day’s racing.
--Stipendiary Steward Mr P Knowles charged Junior Horseman Mr R Tither under Rule 869 (3) (b) alleging that in Race 4 Mr Tither, driving ANVIL DOBSON, shifted outwards causing interference to RED DOT (Miss J Malcolm) causing RED DOT to break with approximately 250 metres to run.

--Stipendiary Steward Mr P Knowles charged Junior Horseman Mr R Tither under Rule 869 (3) (b) alleging that in Race 4 Mr Tither, driving ANVIL DOBSON, shifted outwards causing interference to RED DOT (Miss J Malcolm) causing RED DOT to break with approximately 250 metres to run.
--The Rule states that No Horseman shall drive carelessly. Mr Tither admitted a breach of the Rule and was supported throughout the hearing by Senior Horseman Mr A Beck.
--Mr Knowles produced a written document from Mr Edward Rennell, the General Manager of Harness Racing New Zealand, giving Mr Knowles approval to proceed with this charge.
--Stipendiary Steward Mr Allison used several video clips of the alleged incident, stating and highlighting Mr Tither’s outward movement causing interference to RED DOT (Miss J Malcolm) which then broke. Mr Allison then stated that RED DOT was struggling to maintain his position but was entitled to be where he was on the racetrack.
--Mr Tither agreed with Mr Allison’s statement, stating also that he believed Miss Malcolm could have taken a hold of her horse RED DOT. Miss Malcolm had pulled the ear plugs on her horse, causing that horse to pick up the bit 20 metres previous to the incident, Mr Tither stated. Mr Beck agreed with Mr Tither’s opinion.
--DECISION
--The Committee upheld the charge, accepting that Mr Tither, driving ANVIL DOBSON, has shifted outwards causing interference to RED DOT. The video films clearly show Mr Tither was not clear and did not look at any point. The Committee requested submissions on penalty.
--Mr Knowles stated in his opinion the infringement was in the low to middle range of Careless Driving and that a fine in the range of $200 to $300 was appropriate. Mr Knowles produced Mr Tither’s driving record which showed that there were no charges under this Rule in the past twelve months, and that Mr Tither had a good record.
--Mr Tither made no submissions on penalty.
--In fixing penalty the Committee took into account Mr Tither’s admitting of the breach and his recent driving record. Mr Tither was fined the sum of $250.00.
