Decision:

An Information was laid by Stipendiary Steward Mr T TAUMANU alleging that Trainer Mr K SMITH was late  presenting horses GREG BRYDON and OUR FREDDIE into the assembly area and onto the track prior to race 8.



An Information was laid by Stipendiary Steward Mr T TAUMANU alleging that Trainer Mr K SMITH was late  presenting horses GREG BRYDON and OUR FREDDIE into the assembly area and onto the track prior to race 8.

Mr Smith appeared for the Hearing and denied the charge.

Evidence was heard from the Registrar Mrs C SHAW whose raceday duties also included checking horses into the parade area and onto the track, that Mr Smith’s horses for race 8 were presented late.  The standard reporting time to the assembly area is twelve minutes before the race starting time as depicted on the indicator board in the centre of the track.  GREG BRYDON was presented 8 minutes before the scheduled start time and OUR FREDDIE 7 minutes.  All other horses entered for the race had left the assembly area and the gate accessing the track had been shut.  Mrs Shaw had endorsed the time to run before the race in her race book and identified the horses from their numbers before instructing the duty steward to reopen the gate for these horses to access the track.

Mr Taumanu said that their initial investigations with Mr Smith revealed that his time reference was a Vodafone which displayed a 4 minute variation to the indicator board time.

He said the operation of the raceday very much depended on timeliness and the operating Club was subject to penalties if it was late in delivering and coordinating the race events.  The accepted time for operational purposes was the TAB timings as displayed on the indicator board. All participants on race day referred to the TAB displayed time for guidance.

Mr Smith contended he was dealing in real time which was connected through his vodafone to GMT and that given the opportunity he could show that his horses were not presented late according to this method of timing. Mr Smith contended that his time was correct and that the indicator board which he could not see from the stables was wrong as was the TAB timing.

Decision and Reasons

I am satisfied that your horses have been presented late for Race 8  by the recognised raceday time as displayed on the Indicator Board.

Your reference to Vodafone timing because you could not see the indicator board may in someway mitigate your fault however the majority of the 150 plus horses were presented for racing today in a timely manner and most of those participants have used the recognised TAB coordinated timings to address their commitments and to avoid delays to the race schedule.

--

The standard fine for a breach of this nature is $100.00.  This penalty has been sought by Mr Taumanu and I see no reason to vary from this standard.

Accordingly you are fined $100.00
