Following the running of race no. 7 information was lodged against Mr Allen alleging a breach of Rule 858(1)(a) alleging that being the rider of "Wild Planet", placed 5th by the judge, he failed to weigh-in.

Following the running of race no. 7 information was lodged against Mr Allen alleging a breach of Rule 858(1)(a) alleging that being the rider of "Wild Planet", placed 5th by the judge, he failed to weigh-in.

Mr Hunter said that after the race the stipendary stewards observed Mr Allen dismount and make no attempt to weigh-in within the required time.

Mr Allen, for his part, said that he had simply overlooked the requirement to weigh-in and could offer no other reason for his failure to comply with his obligations on this occasion.

In respect of penalty, Mr Hunter advised the committee that Mr Allen had no previous offences of this type over recent times, that he was a senior jockey and had been entirely co-operative with the stipendary stewards when approached regarding his oversight. Mr Allen confirmed that during his long riding career this was only the second time, in his recollection, that he had failed to weigh-in when required. He was clearly upset about his oversight and was thankful that neither of owner or the betting public had been prejudiced by that.

The committee, after consideration of submissions of Mr Hunter through Mr Allen, are of the view that a monetary penalty only should be imposed and on this occasion the penalty is set at $150.
