It was alleged that IN THE CREEK (NO.12) CJ Barron, started from the incorrect barrier position in that it started from 3 on the second line instead of the unruly position.

DECISION & REASONS:
--It was alleged that IN THE CREEK (NO.12) CJ Barron, started from the incorrect barrier position in that it started from 3 on the second line instead of the unruly position.
--Using video, Stipendiary Steward Mr P Knowles, pointed out that IN THE CREEK appeared to start from 3 on the second line position.
--The starter Mr BW Ward, stated that his official card did not show any horse on the unruly position.
--Mr Barron, driver of IN THE CREEK, said that the No.6 horse FLAMINGO QUEEN, was going rough and hanging back into what would have been the unruly position ? at least 1-1/2 lengths from the front line. HEAVEN SCENT, No.1, was also well back and not in line, which tended to give the appearance that IN THE CREEK was starting in the wrong position.
--Mr Knowles agreed with each of the points made.

--The protest was dismissed for the following reasons ?

- Horse No.6 was well back from the mobile gate in the run up, forcing No.12, IN THE CREEK, to run inside that runner. Horse No.6 actually took up the unruly position (thus making it impossible for No.12 to take up that position). --
- Starter, Mr B Ward, had not been informed that there was an unruly hors in the field. --
- The starting position of No.1, HEAVEN SCENT, which was hanging back at the start made it appear that No.12, IN THE CREEK, was starting from the second line, not the unruly.
