THE FACTS

Mr M Hamilton was charged by the Stipendiary Steward, Mr S Ching, pursuant to Rule 867(3)(c) in that he attempted to start "Magic Man" in Race 8 in excessively worn and defective plates.

Mr Hamilton indicated on the Information that he admitted the breach of the Rule, which is therefore deemed to be proved.

--

Mr Hamilton elected not to be present at the hearing of the Information.

--

Mr Ching informed the hearing that the horse "Magic Man", was brought to the track with excessively worn and defective plates, and that this fact was drawn to the Plating Inspector's attention by Mr Hamilton. As a consequence, the plates were removed and the plates were produced to the hearing as exhibits. A visual inspection of the plates confirmed the allegation in the Information.

PENALTY DECISION

Mr Ching submitted that a fine was an appropriate penalty and made reference to earlier fines of $100 and $200 having been imposed, on other trainers.

We have noted that Mr Hamilton was candid in terms of his communications with the Plating Inspector in good time before the race. He did not leave the re-plating of the horse until the last minute and thus, there was no inconvenience to the running of the race meeting.

--

Mr Hamilton's discussions and the re-plating of the horse at an early stage of the day are quite clearly significant mitigating factors in relation to the penalty that is to be imposed.

--

--

The starting point for the imposition of the penalty in this case would normally be a fine in the region of $400, but having regard to the mitigating factors set out above, we have elected to instead, impose a fine of $200.
