| -- DECISION AND REASONS: --Following the running of Race 11, the Lamb & Hayward Pace, an information was lodged by Stipendiary Steward Mr B. D. Williams against Ms M. A. Nyhan, licensed trainer of "No Fixed Abode" (7), alleging a breach of Rule 849(2). It was alleged that the defendant presented "No Fixed Abode" with the incorrect numbered saddle cloth. --Mr P. J. Davis, on behalf of Ms Nyhan, had indicated on the information that this breach was admitted and that he did not wish to attend the hearing. --Mr Williams stated that the horse had gone on to the track before the wrong numbered saddle cloth had been noticed. --Mr Williams recommended a fine of $200-00 for this breach and explained --that a breach of this Rule is regarded as more serious where the horse manages to get on to the track before the error is noticed. --After considering the matter of penalty, and after looking at previous fines for breaches of this Rule, we were satisfied that $200-00 was an appropriate fine in these circumstances. Ms Nyhan was fined the amount of $200-00. ---- -- --
