| -- This hearing was adjourned from the 24th September 2004 and the information stated that horseman Mr G Small drove Sir Alistair carelessly when he jostled with High Calibre (B Mangos for approximately 200 meters over the early stages of the race. --Mr Small did not admit the breach of this rule and was present at this hearing. --Mr Muirhead opened his case by showing the video of this incident and this clearly showed Mr Small (Sir Alistair) , which was racing on the outer of High Calibre attempting to shift High Calibre down to the running line. This movement went on for a period of approximately 200 meters and Mr Muirhead stated in evidence that Mr Small did not have a clear advantage over Hugh Calibre and therefore he should not have continued with this maneuver. The video was clear that Mr Mangos had his horses head turned out and Mr Small had his horses head turned inwards. Mr Small gave evidence and stated that he had attempted to shift High Calibre down to the running line and it was his opinion that he had an advantage over High Calibre in the early stages of this manoeuver however these two horses had locked stays Mr Small, when getting clear of High Calibre the hopple had broken on his horse causing Sir Alistair to be pulled up. Mr Mangos gave evidence and stated that Mr Small had no advantage over him and that he was always in advance of Sir Alistair therefore Mr Small should have not continued with this movement. Mr Mangos also acknowledged that these two horses had locked stays. --Decision And Reasons --This judicial finds the charge under rule 869(3) (b) , proven, we find that Mr Small was careless in that he did not have a clear neck advantage over High Calibre at any stage and should have not proceeded to put pressure on High Calibre for 200 meters. --We acknowledge that both horses locked stays however this could have been avoided if Mr Small had not continued with the pressure Sir Alsitair was asserting on High Calibre. --Submissions were heard on penalty from both Mr Muirhead and Mr Small the driving record of Mr Small was relatively clear as stated by Mr Muirhead. Mr Small did not have a significant number of drives in the past twelve months and preferred a suspension of his horseman's licence. --We therefore order that Mr Small's horseman's licence is suspended up to and including the 15th October 2004. |
