Mr Todd admitted a breach of R 638(3)(b) in that being the rider of RASPUTIN in race 4 he used his whip in an excessive manner in the straight between the 400 and 200 metres mark. We thus find the charge proved.
--Mr Davidson had Ms Moore, stipendiary steward, demonstrate the breach on the video. This showed Mr Todd hitting RASPUTIN some 10 to 12 times over a distance of some 200 metres without going back to the whip rein.
--Mr Todd’s record is clear under this Rule and Mr Davidson asked for a fine in the range of $200. Mr Todd did not disagree.
--Having regard to Mr Todd’s excellent record and his ready admission of the breach, we believe the matter can be dealt with by way of a fine of $200. Mr Todd is reminded of his obligations under the Rules of Racing.
