Mr Todd admitted a breach of R 638(3)(b) in that being the rider of RASPUTIN in race 4 he used his whip in an excessive manner in the straight between the 400 and 200 metres mark. We thus find the charge proved.

Mr Davidson had Ms Moore, stipendiary steward, demonstrate the breach on the video. This showed Mr Todd hitting RASPUTIN some 10 to 12 times over a distance of some 200 metres without going back to the whip rein.

--

Mr Todd’s record is clear under this Rule and Mr Davidson asked for a fine in the range of $200. Mr Todd did not disagree.

--

Having regard to Mr Todd’s excellent record and his ready admission of the breach, we believe the matter can be dealt with by way of a fine of $200. Mr Todd is reminded of his obligations under the Rules of Racing.
