Stipendiary Steward Mr N G McIntyre alleged that horseman Mr D Dunn, driver of FABIANO, committed a breach of the push out rule when moving WILLYGO, driven by S Dickson, wider on the track prior to the 1,000m point.

Considerable video evidence was shown.  It clearly showed Mr Dunn push out Mr Dickson's horse well before the 1,000 metre post was reached.  Mr Dickson had tacked on to the 3 wide line and was forced 4 wide when Mr Dunn came out after Mr Dickson's horse's nose was well forward of Mr Dunn's horse's rump.

Mr Dunn did not dispute that he had done this but said that his horse was over-racing very keenly and he felt it could become dangerous if he did not take this action.  His horse has a reputation for being a notoriously keen racer.  Mr Williamson confirmed this and said his son had driven the horse and had had a similar problem.  Mr Williamson said more experience would have taught Mr Dunn to call out.

Mr McIntyre asked why Mr Dunn had not called out but he said not as he thought he could control it.  Also, Mr Dunn when asked why his horse had broken, had not mentioned the incident but said his horse had hit a knee.

DECISION  & PENALTY

I feel Mr Dunn should have called for room.  Also he had admitted breaking the push out rule because his horse was racing fiercely.  It is agreed that this horse has a reputation for this.  I feel if I find the charge proven I would expect the horse's reputation to be taken into account when setting the penalty.  However I cannot find the charge not proved but ask for a penalty to be suggested reflecting Mr Dunn's difficulties.  I therefore uphold the charge.

Mr McIntyre asked for a $200 fine as a first up offence.  Mr Dunn agreed he should have called for room but made no other suggestion.

Taking all the above into account and the fact Mr Dunn is a junior driver I find him $100.
